Q&A: can someone help me understand how medicaid can confiscate savings accounts of family members?
Question by jcsaint: can someone help me understand how medicaid can confiscate savings accounts of family members?
my aunt’s husband has had ongoing medical problems but recently his condition declined severely and he’s now in a nursing home, with no expectation of leaving until he dies.
apparently, they recently switched him to medicaid instead of medicare. and then my aunt discovered that her personal savings account, in her name & social security number, had been taken by medicaid.
the nursing home told her to hire a lawyer and she paid him ,500 to help her protect her remaining assets: 3-bedroom bungalow, older car, etc. she fears she’ll lose her home and have no place to go at age 75!
so should i believe all this, or is she possibly confused?

Medicare does not cover nursing home stays. Medicaid is for those with no assets to pay their own bills. Medicaid was justified in attaching your aunts and uncles assets. they will also put a lien of her house. marriage is a 50 50 deal. Medicaid will take your uncles 50%.
